This Privacy Policy covers the practices of Yobi Ventures, LLC (“Yobi,” “we,” “us,” or “our”) concerning personal information that we collect through the public-facing pages of yobi.ventures (the “Site”).

This Privacy Policy does not apply to personal information collected from those who access the non-public facing portions of our Site via a login or from whom we collect information in other ways, such as information collected under contractual arrangements with our customers, suppliers or those who provide services directly or indirectly in support of our platforms and products.  We address that data through other notices where required.

1. Information We Collection

a. Information You Provide to Us:

You may provide the following types of personal information to us through our “Contact Us” form:

  • Contact details, such as name, email address, phone number and address
  • Professional and employment related data, such as your employer and job title
  • Your questions and information about your interest in Yobi or our partners

b. Cookies and Other Information Collection Technology:

Through the Site, we and third parties may collect information from your computer or other device by automated means such as cookies, web beacons, local storage, JavaScript, mobile-device functionality and other computer code. This information may include unique browser identifiers, IP address, browser and operating system information, device identifiers (such as advertising identifiers), other device information, Internet connection information, as well as details about your interactions with the relevant website, email or other online property (for example, the URL of the third-party website from which you came, the pages on our website that you visit, and the links you click on in a website).  In some cases (such as cookies), the tools described here involve storing unique identifiers or other information on your device for later use.

The Site may include Social Plugins (“buttons”) for Facebook, Twitter, LinkedIn and other similar third party services (“Social Media Service”). These buttons work by using pieces of code coming from the Social Media Service.  This code allows you to connect to the Social Media Service, and allows the Social Media Service to collect information about your activity while you are on our website, including your Internet Protocol address, the pages you visit, the device and browser you are using, and more. You can review the privacy policies of Facebook, Twitter and LinkedIn to learn more about the data they collect, and how to manage or control that collection in your account settings.

c. Information From Third Parties

We may also receive personal information from third parties, including our customers, service providers, business partners and business information vendors, as well as from publicly available sources. We also may infer personal information about you based on your interactions with us and the data we collect from you.

d. Children and Individuals Under the Age of Eighteen

The Site is not meant for individuals under the age of eighteen. Yobi will never knowingly request personal information from any child. If you are under eighteen years old, please do not provide your information on the Site. Upon notification that a child has directly provided us with personally identifiable information, we will delete the child’s personally identifiable information from our records. If you believe we might have any information that we have collected directly from a child, please contact us at info@yobi.ventures.

2. Use of Information

We use the information described above for the following purposes:

  • Manage and improve our operations and products;
  • Conduct business operations in support of our core activities, such as security, fraud prevention, analytics, and research and development;
  • Contact you regarding Yobi and business or related opportunities, and other subjects that we think may be of interest to you;
  • Communicate with you and to provide you with the information that you have requested from us, and for relationship management and marketing purposes;
  • Customize content, preferences, and advertising on our websites, across the Internet and elsewhere;
  • Create aggregated or de-identified information, which we may use and disclose without restriction;
  • Comply with laws, regulations, and other legal process and procedures; and
  • Establish, exercise, or defend our legal rights.

3. Sharing of Information

We may share your information as follows:

  • With Service Providers: We may share your information with companies that provide services to us, such as providers of data storage, marketing, web hosting, security, analytics, and fraud prevention. We share your contact information with our service providers who manage our website and distribute our newsletters and communications.
  • With Business Partners: We may share information with our customers, suppliers or other business partners in connection with our own internal operations and the marketing of our services.
  • Legal: We may share information when we believe disclosure is appropriate due to a subpoena or similar investigative demand, a court order, or other request from a law enforcement or government agency, or as otherwise required by law.
  • Protection of Yobi and Others: We may share information when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our employees, our partners, or others; and to enforce our contracts.
  • Corporate Transactions: We may disclose your information as part of, or to take steps in anticipation of, a sale of all or a portion of our business, a divestiture, merger, consolidation, asset sale, bankruptcy, or other significant corporate event.
  • Other Lawful Disclosures: We may engage in other sharing of your information that is not legally prohibited.

4. Protection of Information

Although we maintain certain security measures, we cannot assure you that your personal information will remain secure.

5. Your Rights and Choices

You can unsubscribe from Yobi marketing emails by clicking the unsubscribe link in a marketing email or contacting us as described below.

You may be able to set your browser to refuse certain types of cookies, or to alert you when certain types of cookies are being used. Some browsers offer similar settings for HTML5 local storage and other technologies. However, if you block or otherwise reject cookies, local storage, JavaScript or other technologies, the Site may not function as expected.  

To opt out of Google Analytics cookies on our websites, please visit them only with browsers on which you have installed the Google Analytics Opt-out Browser Add-on.  

If you replace, change, upgrade or reset your browser or device, or delete your cookies, you may need to use these opt-out tools again. We do not respond to browser-based do-not-track signals.

6. Additional Detail for California Residents

This Section 6 applies only to “personal information” about California residents, as that term is defined in the California Consumer Privacy Act (“CCPA”), and it supplements the information in the rest of our Privacy Policy above. Data about individuals who are not residents of California may be handled differently and is not subject to the same rights described in this Section. This Section applies only to the extent required by the CCPA, so some personal information about Californians is not covered by this Section.

Collection, Use, and Disclosure of California Personal Information:

During the 12 months leading up to the effective date of this Privacy Policy, Yobi collected all of the information described in Section 1 of our Privacy Policy from and about California residents from our Site. This information generally falls into the categories listed in the chart below, to the extent it is personally identifiable. The chart also indicates the categories of third parties to whom we disclosed such data during the 12 months leading up to the effective date of this Privacy Policy.

During the 12 months leading up to the effective date of this Privacy Policy, we did not “sell” (as that term is defined under the CCPA) any personal information collected from the Site.  We continue to refrain from such “sales.”

CCPA Right to Access or Delete Personal Information

If you are a California resident, California law may permit you to request that we:

  • Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information.
  • Provide access to and/or a copy of certain information we hold about you.
  • Delete certain information we have about you.

Certain information is exempt from such requests under applicable law.

To request to exercise any of these rights and receive the fastest response, please contact us using one of the methods in the “Contact Information” section below.  For security and legal reasons, Yobi reserves the right to refuse requests that require us to access third-party websites or services. We also reserve the right to take steps verify your identity to our satisfaction before responding to your request, which may include, depending the type of request you are making, the sensitivity of any data you are requesting, and the nature of your relationship with us: verifying your name, asking you to click on a link that we send to your email address, or requesting that you provide us with information about our relationship that only you are likely to have.

You have certain rights under the CCPA not to be subject to certain negative consequences for exercising CCPA rights.

Requests Made by Agents

If you are an agent making a request on behalf of a consumer, we reserve the right to take steps to verify that you are authorized to make that request, which may include requiring you to provide us with written proof such as a notarized authentication letter or a power of attorney. We also may require the consumer to verify their identity directly with us.

7. Special Notice to Nevada Residents

Yobi does not sell, rent, or lease your personally identifiable information to third parties. If you are a resident of Nevada and would like to submit a request not to sell your personally identifiable information, you may do so by emailing us at info@yobi.ventures.

8. Special Notice to Virginia Residents

Under Virginia law, Personal information or “personal data” means “any information that is linked or reasonably linkable to an identified or identifiable natural person.” “Personal data” does not include de-identified data or publicly available information.  The following applies if you are a resident of Virginia:

  • Request to Access. You may submit a request to confirm, to obtain a copy of, or to gain access to the personal data that Yobi has collected about you including what the data is, how it has been used, and to whom it has been disclosed. Your personal data may no longer be available because it has been destroyed, erased, or made anonymous in accordance with Yobi’s data retention policies, in which case we will provide you with the reasons why the personal data no longer exists where possible.
  • Request to Correct. You may correct or update your personal data at any time by contacting us.
  • Request to Delete. You may request that Yobi delete the personal data provided by or obtained about you. We will delete your personal data from our records and direct any service providers to do the same unless retention is required by law.
  • Request to Opt-Out. You may submit a request to opt out of the sale of your personal data as well as its processing for targeted advertising or consumer profiling. Yobi does not sell, rent, or lease your personal data to third parties and does not process your personal data for targeted advertising or consumer profiling.
  • Appeal. If we notify you that no action is to be taken in response to your request to access, correct, delete, or opt-out, you may appeal this decision by contacting us within 30 days with the reason why you believe further action should be taken. If you are not satisfied with the result of the appeal, you may contact the Virginia Attorney General or submit a complaint online at https://www.oag.state.va.us/consumer-protection/index.php/file-a-complaint.

If you choose to submit a request, you must provide us with enough information to identify you in order to comply with your request. Yobi will only use the information it receives to respond to your request. Yobi will not be able to disclose information or comply with your request if it cannot verify that the person making the request is the person about whom we collected information, or someone authorized to act on such person’s behalf.

9. Special Notice to Colorado Residents

Under Colorado law, personal information or “personal data” means “information that is linked or reasonably linkable to an identified or identifiable individual.” “Personal data” does not include de-identified or publicly available information. The following applies if you are a resident of Colorado:

  • Request to Access. You may submit a request to confirm or to obtain a copy of or access to the personal data that Yobi has collected on you including what the data is, how it has been used, and to whom it has been disclosed. Your personal data may no longer be available because it has been destroyed, erased, or made anonymous in accordance with Yobi’s data retention policies in which case we will provide you with the reasons why the personal data no longer exists where possible.

10. Updates and Changes to this Policy

Yobi may update this Privacy Policy from time to time, such as to reflect changes in our practices or for legal reasons. We will post those changes here or on a similarly accessible page.
